Terms and Conditions

1. In these Terms and Conditions, the following words and expressions, unless the context otherwise admits or requires, have the following meaning :-

• "Company" means[Xcellink Group of companies : Xcellink Pte Ltd, Xcellink Sdn Bhd, Xcellink Inc]; "Information" means any information submitted by the job seeker and transmitted via this on-line application service.
• "Database" means the database established, operated and maintained by the Company which contains information and particulars of job seekers.
• "Personal Data" means the personal particulars of a job seeker submitted by the job seeker and transmitted via this on-line application service.
• "Resume or Curriculum Vitae" means the resume or curriculum vitae of a job seeker submitted by the job seeker or compiled from the Personal Data and Information submitted from time to time by the job seeker and transmitted via this on-line application service.

2. The job seeker warrants that: -

(a) the reproduction of the Personal Data, Information, Resume or Curriculum Vitae as submitted by the job seeker and transmitted via this on-line application service will not breach any contract or infringe or violate any copyright, trademark or any other personal or proprietary right of any claim or person or render the Company liable to any claim or proceedings whatsoever;

(b) any Personal Data, Information, Resume or Curriculum Vitae and contents supplied in connection with the Resume or Curriculum Vitae submitted by the job seeker is accurate complete, up to date and true and are supplied for the sole purpose of seeking job or employment vacancies or positions;

(c) any Personal Data, Information, Resume or Curriculum Vitae complies with the requirements of all relevant law, legislation, rules and regulations for the time being in force and applicable in all relevant jurisdictions;

(d) all Personal Data, Information and contents inserted by the job seeker and transmitted via this on-line application service is legal, decent, honest and truthful

3. The job seeker acknowledges that it is not the Company's policy to exercise editorial control over or to edit or amend any Information or Resume or Curriculum Vitae, or any other information that may be inserted or made available via this on-line application service. Without prejudice to the other provisions of the Terms and Conditions, the Company may refuse, suspend, terminate, delete or amend any artwork, materials, information or content of any Information, Resume or Curriculum Vitae submitted by the job seeker so as, in the sole opinion of the Company, to comply with the legal or moral obligations placed on the Company or to avoid infringing a third party's rights or any other rules, standards or codes of practices that may be applicable to the Internet.

4. The job seeker shall not : -

(a) distribute, publish, insert, transmit or otherwise exploit any information, materials and contents via this on-line application service other than information, materials and contents which the job seeker owns or otherwise has a right to use in such manners;

(b) insert, publish, distribute, transmit or circulate any unsolicited advertising or promotional information or any content via this on-line application service that is not authorised by these Terms and Conditions or is otherwise obscene, indecent, seditious, offensive, defamatory, threatening, liable to incite racial hatred, discriminatory, menacing or in breach of confidence.

5. Only successful applicants or shortlisted candidates will be notified.

6. Any Information of the job seeker contained in the Database may, at the sole discretion of the Company, be erased and deleted from the Database and destroyed without prior notice for whatever reason. The job seeker shall have no right to recall or demand the return of any Information upon submission to the Company. The Company reserves the right to share the Information with its affiliates and agents.

7. The Company shall not be liable for any loss and damage, costs and expenses that may be suffered or incurred by the job seeker from use of this on-line application service. This includes without limitation loss of data resulting from delays, non-deliveries, mis-deliveries or services interruptions or errors or omissions or due to inadvertent release or disclosure of information by the Company or reason beyond the reasonable control of the Company.

8. The Company makes no representations and warranties of any kind, whether expressed or implied, for this on-line application service and in relation to the accuracy or quality of any information transmitted or obtained through this web site.

9. Without prejudice to the other provisions of these Terms and Conditions, the Company shall not be liable for

(i) any damage to or loss of data suffered by the job seeker arising from the job seeker's use of this on-line application service;

(ii) any claim based in contract, tort, or otherwise for any loss of revenue (whether direct or indirect), loss of profits or any consequential loss whether of an economic nature or not;

(iii) any claim relating to any data or information supplied, provided, or made available by or through this web site (or any failure or delay to so supply, provide, or make available)

(iv) any injury, disease, seizure or loss of consciousness suffered by the job seeker, arising whether directly or indirectly from accessing and using this web site and/or the on-line application service; and (v) any disruption or suspension of this website or any part thereof.

10. These Terms and Conditions and the rights and obligations contained hereunder shall be governed by and construed in accordance with laws of Singapore. The Courts of Singapore shall have the jurisdiction to hear and determine any suit action or proceeding, and to settle any dispute, which may arise out of or in connection with these Terms and Conditions and the parties hereby irrevocably submits to the jurisdiction of such Courts.
